1. Introduction
These Terms of Service ("Terms") govern your access to and use of the website located at envisionprivate.com.au (the "Site"), which is operated by Envision Private ("Envision Private", "we", "our" or "us"). By accessing or using the Site you agree to be bound by these Terms. If you do not agree, do not use the Site.
2. About Envision Private
Envision Private is an Australian private credit firm that arranges wholesale, property-secured lending on behalf of high-net-worth individuals, sophisticated and wholesale investors (within the meaning of section 708 of the Corporations Act 2001 (Cth)) and family offices. We are not an NCCP-regulated lender and we do not provide consumer credit or credit assistance under the National Consumer Credit Protection Act 2009 (Cth).
3. No advice
Information on the Site is general in nature and does not constitute financial product advice, credit advice, tax advice, or legal advice. Nothing on the Site takes into account your personal objectives, financial situation or needs. Before making any decision, you should obtain independent professional advice from an appropriately qualified adviser.
4. Wholesale investors only
Any investment opportunity referenced on the Site is available only to persons who qualify as wholesale, sophisticated or professional clients under Chapter 7 of the Corporations Act 2001 (Cth). Retail investors are not eligible to invest in opportunities offered or arranged by Envision Private.
5. No offer
The Site does not itself constitute an offer or invitation to acquire any financial product. Any offer will be made only pursuant to a separate information memorandum or equivalent disclosure document provided to eligible wholesale investors.
6. Use of the Site
You agree that you will not:
- use the Site for any unlawful purpose or in a way that breaches these Terms;
- copy, republish, distribute or exploit any content from the Site without our prior written consent;
- attempt to gain unauthorised access to the Site or the systems supporting it; or
- use automated means to scrape, index or otherwise access the Site other than for reasonable indexing by legitimate search engines.
7. Intellectual property
All content on the Site, including text, graphics, logos and layout, is owned by or licensed to Envision Private and is protected by Australian and international copyright laws. You may access and read content for personal, non-commercial use only.
8. Third-party links
The Site may contain links to third-party websites. We do not endorse or assume any responsibility for third-party content, products or services.
9. Limitation of liability
To the maximum extent permitted by law, Envision Private, its officers, employees and related bodies corporate exclude all liability for any loss or damage (including indirect or consequential loss) arising from your use of, or reliance on, the Site or any content on it.
10. Governing law
These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales.
11. Changes
We may amend these Terms at any time by posting an updated version on the Site. Continued use of the Site after changes are posted constitutes acceptance of those changes.
