What is the NCCP Act and why are private business loans outside it?

The National Consumer Credit Protection Act 2009 (Cth) regulates credit provided to individuals for personal, domestic, household or residential-investment purposes. Loans genuinely for business or investment purposes fall outside it — which is why private commercial lending is described as non-NCCP, or unregulated, credit.

What the NCCP covers

The NCCP applies to consumer credit: a home loan, a personal loan, a credit card, or a loan to buy or refinance residential investment property. Where it applies, the lender or broker must hold an Australian Credit Licence and comply with responsible lending obligations, disclosure requirements and hardship provisions.

Credit provided predominantly for business or investment purposes other than residential property investment falls outside that regime.

What being outside the NCCP means in practice

Responsible lending obligations and the statutory hardship framework do not apply, disclosure is governed by the contract rather than prescribed consumer forms, and dispute resolution is generally through the courts rather than AFCA's consumer jurisdiction.

This is precisely why private credit can be structured flexibly and fast — and it also means the loan documents themselves carry the weight. Independent legal advice before signing is not a formality.

Business purpose declarations

Lenders take a business purpose declaration confirming the loan is wholly or predominantly for business or investment purposes. Providing a false declaration is serious: it can invalidate the basis of the facility and expose the borrower.

If a loan is genuinely for personal, domestic or household purposes, it should be arranged by a licensed credit provider under the NCCP — not through a commercial private credit facility.

Is an unregulated loan unsafe?

Not inherently. It means consumer protections do not apply, so the contract terms and your own legal advice carry more weight. Reputable commercial lenders document transparently.

Can I use a business purpose loan to buy a home to live in?

No. That is consumer credit and must be arranged under the NCCP by a licensed credit provider.

Does the NCCP apply to loans to a company?

Generally not, since the NCCP protects natural persons and strata corporations for consumer purposes. Company borrowing for business purposes sits outside it.
